Do you have to accept the insurance company’s offer for your car?

You were involved in an accident and your car is a total loss. The insurance company makes you a monetary offer to replace your vehicle. Do you have to accept that offer if you don’t think it is fair?

The answer to that is no, but you must be prepared to present the adjuster with comparable vehicles. Vehicles of the same model, from the same year, with similar features. If the amount they’ve offered you is not enough to buy a car of that meets those requirements, then it’s simply not going to be a fair offer.

Another “trick” the insurance companies try to pull, is they try and get you to retain the “salvage value” of the car. If you want to get as much money as possible for your car, it is best to let them take the salvage not for you to retain it.

Delayed symptoms after a car accident… What should you do?

You were involved in an accident and felt no physical pain or discomfort. However, after a few days, you’re starting to feel something’s not right.

This is actually very common after a car crash,  when your adrenaline’s running, you’re in fight or flight mode. You’re really not paying attention to how you’re feeling at the moment because you’re so excited. But you finally get home and start feeling symptoms. Common symptoms are stomach pain, swelling, dizziness, and fainting.

Sure it can appear suspicious to the insurance company but it is far more common than you would think. The fact is these symptoms can be signs of more serious injuries that you didn’t realize you suffered at the time of all the commotion from the collision.

My insurance company is calling. Should I return the calls?

You have been in an auto accident in California.  Maybe there are different perspectives on what happened.  Maybe you or others were injured.  You probably have questions about what happens next with the other side, insurance companies, and attorneys.  Perhaps they are already contacting you.  You’re wondering how you should respond.

It is important to differentiate between your own insurance company and the other driver’s insurance company.  When you have your own insurance company calling, you have a duty to cooperate and return their calls.  They can deny coverage if you do not cooperate with them.  The information you provide helps them to investigate liability in the case, and this process may uncover facts that affect your results.  If you have retained an attorney by the time your insurance company calls – which is often the case – your attorney can handle those calls.
