You’re minding your own business and all of a sudden someone comes up to you, calls you by your name, hands you a subpoena and says, “You’ve been served.” As if that isn’t enough of a shock, the date that they want you to appear in the subpoena is a date that you’ve already got plans. Maybe it’s a prepaid vacation out of the country. Maybe it’s your honeymoon. Maybe it’s a day that you’re going to be unable to attend the deposition. What do you do? Hi, I’m Frank Nunes. I’m a California civil trial attorney practicing in the state of California. The first thing you do is make sure you get your witness fees. If they’re going to subpoena you, they need to give you those witness fees. They can be trivial. Ask for them anyway. In California, at this time as of October 1st, 2020, the witness fees are $35 and 20 cents a mile, both ways, to and from the point of appearance.
The second thing you do, if the data’s not correct, there’s got to be an address and a phone number for the attorney who has subpoenaed you, or the party that has subpoenaed you. Contact that attorney, let them know your situation, and be honest with them. Tell them, “I’m willing to appear. I’m willing to give testimony, but I can’t do it on the date that you’ve noticed me do it.” Above all, stay calm. I realize nobody ever expects to be served, whether it be a subpoena or any other thing. It’s the kind of invitation you don’t look forward to getting.
