Can the Careless Party’s Attorneys Subpoena All Your Medical Records

Can you sue the parents of a careless child? Hi, I’m Frank Nunes. I’m a California personal injury trial attorney, practicing in the State of California. The answer to that question is generally no. Parents are not responsible for the misdoings or misgivings of their child. However, the exception to that rule applies when the parent knows of prior instances of the child’s bad conduct, and does nothing to stop that from happening again.

That isn’t always a bright-line rule, and every case can depend on its own facts. But generally, as a rule, the parents are not liable until there’s some prior history of bad acts by the child, and the parents aware of it, and done nothing to do anything about it.
