You were injured in a crash caused by a drunk driver. You hired your own attorney because you have harms and losses from the crash. Now you’re getting a phone call from the district attorney or perhaps the criminal defendant’s attorney. What do you do? Hi, I’m Frank Nunes. I’m a California personal injury trial attorney practicing in the state of California. It’s not uncommon for there to be a criminal and a civil case pending at the same time. Oftentimes the DUI will be going through trial much faster than the civil case, and the district attorney may contact you to give testimony or to get information about the harms and losses that you suffered. On occasion, a defense attorney for the drunk defendant may call you as well, but that’s not very likely. So what do you do when you get those kinds of calls and you already have an attorney?
First, let your civil attorney know that this person is contacting you. Politely tell the attorney that’s called you, I do have an attorney, his or her name is this and their number’s this. Please contact them first. Then they will call the attorney, clear what they want to discuss and then we will work out an arrangement to help with the criminal prosecution of the case. So that’s usually the best way to handle it when the district attorney or even the defense attorney calls you and you already have an attorney.
