But the accident wasn’t your fault, why should your insurance have to pay for the claim? Hi, I’m Frank Nunes. I’m a California personal injury trial attorney, practicing in the State of California. So many times I meet with people and they say, “Why is my insurance paying when it wasn’t my fault?” Well, here’s why. One in every seven vehicles on the road does not have insurance. So why do you need to carry insurance? That’s why to protect yourself from careless acts of people who don’t take the time to insure themselves and be responsible for their actions.

Uninsured motorist coverage protects you just as much as it protects you when you hit somebody else’s car. In California back in 1988, the voters passed Proposition 103. It limits an insurance company’s ability to raise your rates when you turn in an uninsured motorist claim. I get this so often. People say, “Well, if my insurance is going to pay, my rates are going to go up.” Thankfully, there’s the laws that have been acted to protect that. It’s not always a guarantee but if it isn’t a guarantee, you can vote with your pocketbook and go to another insurance company.

Oftentimes, your insurance company will file a lawsuit against the uninsured driver to recover the money they paid out on your claim to you. So why am I telling you this? Because so many people come to my office and they can’t understand why their insurance has to pay for their claim when the other driver was at fault. They worry about their rates going up. Fortunately, that’s what uninsured motorist coverage is for, that’s why you bought it. It’s there to protect you just as much as every other coverage on your policy.
