The Light Turns Green, You Go Forward And You Are At Fault How Can That Be

The light turns green and you go forward, and now you’re at fault for the crash. How can that be?

I just heard something so strange the other day. I want to share this story with you. A client of mine was sitting at a red light, her light turned green, she slowly proceeded in the intersection to make her turn, when wham a car came from behind and hit her going the opposite direction. I get a phone call from the other driver’s insurance adjuster. She’s trying to tell me that my client’s at fault because she didn’t look both ways in the intersection before she entered it. She had the green light.

California law says you have an obligation to follow the law. California law also grants others the ability to expect that they will follow the law. So in this case, when my client was parked and stopped for the red light, her light turned green and this car comes out of nowhere from the side and hits her, she had every reason to expect that car was going to stop and she was in no way culpable for injuries.
