What is a petition to compromise a minor’s claim? Hi, I’m Frank Nunes. I’m a California personal injury trial attorney practicing in the state of California. Oftentimes, you’ll hear the term minor’s comp, which is short parlance for petition to compromise disputed claim of a minor. Well, what is it? It is a process where the court has to approve the settlement that’s been negotiated by the attorneys or the parties for somebody who’s underage and can’t make decisions for themselves.

During the process, a lengthy form is presented to the court for review. The judge will review all the documents, look at the harms and losses to the minor, look at the amount of the settlement, look at the amount of money available, any future medical care and other bills, and even the amount of attorney’s fees to make sure they are fair and just to this child who’s too young to make decisions for him or herself. Those are just a few points of a minor’s compromise.
